Damage caps

Ordinary malpractice damages for a living patient are not limited by a statewide noneconomic ceiling. In a wrongful-death case, damages for loss of comfort, society, and companionship are capped at the published inflation-adjusted figure. For a death in 2026, that figure is $1,056,500. Punitive damages in a wrongful-death case are capped at $500,000. Pecuniary wrongful-death losses are not limited by the comfort and society ceiling.

Not capped

Economic damages

Economic losses for a living patient are limited by proof. Pecuniary injuries in a wrongful-death case, the financial loss, are not limited by the comfort and society ceiling. The jury may award fair compensation for those pecuniary injuries.

Death cases only

Noneconomic damages

A surviving patient's compensatory damages are not limited by a statewide noneconomic ceiling. In wrongful death, damages for the loss of comfort, society, and companionship of the deceased, including emotional distress from the same facts, may not exceed the inflation-adjusted amount under section 2-807. For a person who died in 2026, the Maine Probate cost-of-living figure is $1,056,500. Use the death year, not the year the case resolves.

This page states the 2026 death-year figure from the Probate cost-of-living table. It does not restate other years. Confirm the table if the death year is not 2026.

The comfort and society ceiling is a wrongful-death limit. It does not cap a surviving patient's noneconomic damages. Confirm how multiple defendants share the death figure on the facts.

Wrongful-death comfort and society

The death year selects the inflation-adjusted comfort and society figure. A surviving patient's claim is not on this schedule. These are statutory descriptions, not payment averages.

The $1,056,500 figure is the Maine Probate cost-of-living amount under 18-C M.R.S. section 1-108 for section 2-807 comfort, society, and companionship damages when the death is in 2026. Punitive damages in a wrongful-death case are separately capped at $500,000. Pecuniary losses are outside the comfort and society ceiling. Other death years use other published adjustments. This page does not restate them.

Punitive damages

Punitive damages in a wrongful-death action are capped at $500,000 under section 2-807. That punitive ceiling is separate from the comfort and society figure.

Filing deadlines

Accrual is usually the date of the act, with a three-year filing period. Foreign-object claims run from discovery. Start the notice and panel process early, because it is required before ordinary trial proceedings.

General rule

An action for professional negligence must be commenced within three years after the cause of action accrues. Accrual is the date of the act or omission giving rise to the injury.

24 M.R.S. § 2902 (opens in a new tab)

Foreign object

If a foreign object was left in the body, accrual is discovery, or when the object reasonably should have been discovered.

Minors

A minor's action must be commenced within six years after accrual or within three years after the minor reaches majority, whichever occurs first. Confirm the statutory wording on the facts.

Notice before suit

The claimant must serve and file a sworn notice of claim and proceed through mandatory prelitigation screening before ordinary trial proceedings, unless a narrow waiver applies. Filing fees apply.

Serving and filing the notice begins the screening process and tolls limitations during the required panel period.

What cases often look like

These notes describe public legal patterns. They are not case counts, win rates, or rankings.

  1. Survival and death follow different valuation rules

A living patient's compensatory damages are not under a statewide noneconomic ceiling. A 2026 wrongful-death comfort and society award is capped at $1,056,500, and wrongful-death punitive damages are capped at $500,000.

  2. Notice and the panel come first

The process headline is a sworn notice of claim, mandatory screening, and a three-year period that usually runs from the act.
